Sexual Assault in Nursing Homes

Sexual assault in nursing homes is one of the most underreported types of abuse that nursing home residents face.

MSW has recovered millions of dollars in jury verdicts and settlements for victims of nursing home sexual abuse.  In some of our cases, the attackers have been employees of the facility.  Other times our client has been assaulted by one of her fellow nursing home residents. While each case has its own set of facts, there are common themes among the sexual assault cases we have handled, including:

• Months or years of prior conduct by the attacker, which was ignored;
• Providing the victim’s family with only half-truths, or misdirection;
• Failing to send the victim to the ER for evaluation;
• Delay in reporting to the police;
• Falsifying staff statements about the incident; and,
• Lying in reports to the Departmentof Health.
